Agreement between User and Q Moments

This is the agreement between the user and the DMC. The terms “we”, “us”, “DMC” and “Company” refers to Q Moments, its affiliates and/or their respective and "you" refers to the user/customer booking a reservation though us directly through this website, or indirectly through any of our affiliates. All reservations you book through us are subject to the following terms, conditions and notices as they exist at the time the reservation is made. We reserve the right to change these terms, conditions and notices and you agree to accept and be bound by the terms, conditions and notices that are in effect at the time of your use of our website and facilities.

These Terms of Use govern your use of the Website, and all applications, software, and services (collectively, "Services") available on the Website, except to the extent such Services are the subject of a separate agreement. Specific conditions may apply to the use of certain Services and other items provided to You on the Website ("Service Agreement(s)").

Product and Services

The Website contains information about the products and services which Q Moments (or other third parties) may offer (referred to as Product Information). Product Information may include details about future intentions of Q Moments (e.g. details of destinations it intends to provide its service to or other products/services it intends to launch) and information about its current products. The purpose of providing the Product Information is to help you to find out more about Q Moments’ services and assist you to obtain these services.

Some of the services which make up your booking may be provided by independent suppliers. Those suppliers may provide these services in accordance with their own terms and conditions which will form part of your contract with us. Some of these terms and conditions may limit or exclude the supplier's liability to you, usually in accordance with applicable International Conventions. Copies of the relevant parts of these terms and conditions are available on request from ourselves or the supplier concerned.

Unauthorized use

You agree that your use of this Website is provided solely to permit you to view and purchase our products and services and for no other purpose. In particular, you agree that you will not make any unauthorised, false or fraudulent booking; that you will not attempt to interfere with the operation of this Website, or alter or corrupt any data or software. 

You are responsible for maintaining the confidentiality of Your website access information (such as user names, passwords and personal identification numbers) and booking data (such as booking references and Your travel itinerary).

You may choose to permit family members, friends or colleagues to access the website on Your behalf by providing website access information and/or booking data to such persons provided that:

(a) You have obtained the consent of any other persons whose booking data or personal data is accessible with Your data (such as a group booking); and

(b) You accept full responsibility for the acts and omissions of that person when accessing the website using the website access information and/or booking data provided by you whether such access is authorised by You or not.

You must not permit access to or use of this website or any of the Material on or obtained from this website to any commercial entity or other organisation providing a service to the public.

Commitments

In addition to other restrictions set forth in these Terms of Use, You agree that:

(a) You shall not disguise the origin of information transmitted through the Website.

(b) You will not place false or misleading information on the Website.

(c) You will not use or access any service, information, application or software available via the Website in a manner not expressly permitted by Q Moments.

(f)  You may not use or access the Website or the Q Moments Systems or Services in any way that, in Q Moments judgment, adversely affects the performance or function of the company Systems, Services or the Website or interferes with the ability of authorized parties to access the company Systems, Services or the Website.

(g) You may not frame or utilize framing techniques to enclose any portion or aspect of the Content or the Information, without the express written consent of Q Moments.

You agree to follow and abide by these Terms of Use and by all instructions and procedures set out in this Website. You understand that a failure to follow all instructions and procedures may lead to your obligation to purchase unintended goods or services; forfeiture of your products or services; denial of access to this Website products, or services; and possibly legal action being brought against you.

Website Accuracy

Although Q Moments makes every effort to ensure the accuracy of our website information and pricing, regrettably changes and errors do occasionally occur and we reserve the right to correct prices and other details in such circumstances. Mistakes made by You during the booking process are not binding on us and Q Moments will not be required to honour any booking made in such case. In the event of an error or mistake being made caused by You or by unavoidable and extraordinary circumstances, we reserve the right to cancel any confirmed booking within a reasonable time and refund paid by you in relation to such booking (if applicable), without any liability to us. You must therefore ensure you check the price and all other details of your chosen arrangements before your booking is confirmed.

Prices may change according to your services and date selection. The price displayed is the total for all guests including the taxes, fees and surcharges. 

License and Ownership

Any and all intellectual property rights ("Intellectual Property") associated with the Website and its contents (the "Content") are the sole property of Q Moments or third parties. Our Website’s Content is protected by applicable copyright and other laws.

Elements of the Website are also protected by trade secret, unfair competition, and other laws and may not be copied or imitated in whole or in part. All custom graphics, icons, and other items that appear on the Website are trade marks, or service marks ("Marks") of the company, its affiliates or other entities that have granted the right and license to use such Marks and may not be used or interfered with in any manner without the express written consent of Q Moments. Except as otherwise expressly authorized by these Terms of Use, You may not copy, reproduce, modify, lease, loan, sell, create derivative works from, upload, transmit, or distribute the Intellectual Property of the Website in any way without Q Moments' or the appropriate third party's prior written permission. Except as expressly provided herein, company does not grant to you any express or implied rights to Q Moments' or any third party's Intellectual Property.

Q Moments grants you a limited, personal, nontransferable, non-sublicensable, revocable license to (a) access and use only the Website, Content and Services only in the manner presented by Q Moments, and (b) access and use the network services offered within the Website (the "Q Moments Systems") only in the manner expressly permitted by company. Except for this limited license, Q Moments does not convey any interest in or to DMC Systems, information or data available via company Systems (the "Information"), Content, Services, Website or any other company property by permitting you to access the Website. Except to the extent required by law or as expressly provided herein, none of the Content and/or Information may be reverse-engineered, modified, reproduced, republished, translated into any language or computer language, re-transmitted in any form or by any means, resold or redistributed without the prior written consent of Q Moments. 

Payments

If you are purchasing the services using a debit or credit card via the Website, we will process these payments via the automated secure common payment gateway which will be subject to fraud screening purposes.

If you do not supply the correct card billing address and/or cardholder information, your booking will not be confirmed and the overall cost may increase. We reserve the right to cancel your booking if payment is declined for any reason or if you have supplied incorrect card information. If we become aware of, or is notified of, any fraud or illegal activity associated with the payment for the booking, the booking will be cancelled and you will be liable for all costs and expenses arising from such cancellation, without prejudice to any action that may be taken against us.

Q Moments may require the card holder to provide additional payment verification upon request by submitting an online form. Credit card details are held in a secure environment and transferred through an internationally accepted system.

Disclaimers and Limitations of Liability 

(a) Whilst the Product Information and all other website, mobile site and mobile applications material are provided in good faith, by using this website, mobile site and mobile applications, You agree and acknowledge that Q Moments makes no representations, warranties, or claims as to the accuracy of the Product Information or any other material on this website, mobile site and mobile applications. Furthermore, You agree that the Product Information and website, mobile site and mobile applications material does not constitute any form of advice or recommendation to You.

You agree that Q Moments, in its sole discretion, may terminate or suspend your use of the Website, and the Q Moments Systems, Information, Services and Content at any time and for any or no reason in its sole discretion, even if access and use continues to be allowed to others. Upon such suspension or termination, you must immediately (a) discontinue use of the Website, and (b) destroy any copies You have made of any portion of the Content. Accessing the Website and the Q Moments Systems, Information or Services after such termination, suspension or discontinuation shall constitute an act of trespass.
